Elaine Nolte and Morgan Flournoy each owned an undivided interest in real property in Angelina County, Texas, consisting of fifty acres of land and a dwelling house, to which reference was made as the “small porch home.” 1 Nolte travelled five hours to Angelina County from her home “for the purpose of spending the weekend in the porch house and visiting with family and friends,” only to discover that her key “no longer worked the locks on the doors.” Nolte called Flournoy on the telephone in order to obtain entry, but Flournoy declined to then come to allow…
