The appellee’s relator filed an infor*557mation in the nature of a quo warranto against the appellant to try the right of the defendant to the office of treasurer of Hamilton county, Indiana. It appears from the petition, that appellant was elected to. that office at the November election in 1894, after-wards qualified and entered upon the discharge of the duties of said office on September 7, 1895, and that his two-year term of office expired on September 7, 1897.
