The parties are presently before the Court with respect to the motion of defendant Southern Steel Company (Southern Steel) to dismiss, pursuant to Fed.R.Civ.P. 12(b), this action filed by Consolidated Engineering Co., Inc. (Consolidated) for lack of in personam jurisdiction over Southern Steel as well as for insufficiency of service of process, and for the failure of Consolidated to qualify to transact business in Virginia.
