VAN VALKENBURGH, Circuit Judge.

This is a suit to recover damages for the setting out of a fire by an engine of the Minneapolis & St. Louis Railroad Company, of which appellee is receiver. The Turner Simplicity Manufacturing Company is an Iowa corporation engaged in the manufacture and sale of gasoline engines, with its principal place of business at Oskaloosa in said state. Its plant there consisted of a main factory building two stories high, one hundred feet in length from east to west, and forty feet in width.
