HUTCHESON, Chief Judge.
The suit, for a declaration as to, and for enforcement of, rights under a written contract of date August 8, 1947, 1 which had been entered into by and between the defendants, Armstrong, et al., and Southern Production Co., was brought by Southern and its assignee, Cook Production Co., as plaintiffs.
The claim was: that the contract was a lawful and valid one; that all of the obligations imposed upon Southern by it had been complied with, including the deposit of the estimated drilling costs of the first well; but that defendants had refused to deposit their one-half…
