delivered, the opinion of the Court.

The bill in the present case was filed, asserting- complainant’s title as brother and only heir at law of James K. P. Finley, deceased, to certain real estate in the city of Chattanooga, this State. The principal defendant was James Finley, Jr., claiming the same property' as the' adopted son of James K. P. Finley. A demurrer was filed to the bill, which was sustained by the chan*320cellor, and the bill dismissed. From this decree the complainant has appealed to this court, and assigned errors.
