HOFFMAN, Judge.

Defendant-appellant James Butts appeals the trial court's denial of his motion for discharge.

Three criminal charges were filed against the defendant, Butts, on April 9, 1986. A fourth charge was filed on May 28, 1986.

Defendant was not brought to trial until November 17, 1988, 951 days subsequent to his arrest and 902 days subsequent to the filing of the fourth charge. Defendant was found guilty on Count III, operating a vehicle with a blood aleohol content of .10% or greater, and Count IV, operating a vehicle while intoxicated.
