OPINION

SENTER, Chief Judge.

This case involving a claim of bad faith refusal to pay an insurance claim is before the court for consideration of the defendant’s motion for summary judgment and the plaintiffs’ cross-motion for summary judgment.

I. FACTS

The undisputed facts are as follows: On February 5, 1986, Olivia Chapman was a passenger in an automobile which her husband, Henry Chapman, was driving along Pleasant Hill Road in Shelby County, Tennessee.
