Appeal by the People, as limited by their brief, from so much of a sentence of the Supreme Court, Kings County (Gorges, J.), imposed February 23, 2005, as was imposed upon the defendant’s conviction of criminal possession of a controlled substance in the second degree, upon his plea of guilty, and upon his adjudication as a second felony offender, that sentence being a determinate term of 10 years’ imprisonment.

Ordered that the sentence is reversed insofar as appealed from, on the law, and the matter is remitted to the Supreme Court, Kings County (Gerges, J.), for resentencing on the…
