On January 27/1932, and prior thereto the appellee and defendant below, "W. H. "Wheeler, was a practicing physician in West Liberty, Ky., and was health director for his county of Morgan. As such officer, he became acquainted with the fact that a great many children in the county were suffering from diseased tonsils, and that they should be operated on and their tonsils removed.
