Now pending before the court is defendant’s motion for partial dismissal of plaintiffs amended complaint pursuant to Rule 12(b)(1) of the Rules of the United States Court of Federal Claims (RCFC). The amended complaint, like plaintiffs original complaint, alleges that the United States Department of the Army (Army) breached three contracts with Uniglobe for the lease of vehicles to be used in support of Operation Iraqi Freedom in Kuwait.
