TERNUS, Justice.

The defendant, Adam Donald Musser, appeals his conviction of criminal transmission of human immunodeficiency virus (HIV) in violation of Iowa Code section 709C.l(l)(a) (2001). Musser claims the statute violates the First Amendment, is vague and overbroad, and infringes his right of privacy. 1 He also argues his twenty-five-year sentence constitutes cruel and unusual punishment.
