MEMORANDUM OPINION
SUE L. ROBINSON, District Judge.
I. INTRODUCTION
On December 22, 2003, Praxair, Inc. and Praxair Technologies, Inc. (collectively called “plaintiffs”) filed this action against ATMI, Inc. and Advanced Technology Materials, Inc. (collectively called “defendants”) for infringement of certain claims of United States Patent Nos. 6,045,115 (“the 115 patent”), 6,007,609 (“the ’609 patent”) and 5,937,895 (“the ’895 patent”).
