This action was brought under D.C.Code 1973, § l-804b1 in the name of the District of Columbia for and on behalf of Heller Electric Co., Inc. (Heller) against Weiss Construction Inc. (Weiss) and Weiss’ surety, Hartford Accident and Indemnity Company (Hartford).
In 1975 the District of Columbia entered into a public contract with Weiss for the construction of the Wheatley Playground Addition.
