The parties to this action occupy the same position in this court as they did in the trial court and will be referred to as the plaintiff and the defendant.

This is a suit begun April 20, 1932, in the district court of Oklahoma county on a promissory note for $5,000, executed on February 3, 1931, by the defendant to the plaintiff.
