Appeal from special term, New York county. Action by Elizabeth J. Goldner against Daniel S. Goldner. From a judgment dismissing the complaint, plaintiff appeals.

The action was for a divorce. The defendant having answered, and an order of reference to hear and determine the *432action having been made, the hearing was had before the referee, who found that the defendant was guilty of the charge of the complaint, and reported that the marriage should be dissolved. Application was thereupon made to the court for an order confirming the report of the referee and for judgment thereon.
