Appeal from the District Court of Rio Grande County. Hon. Charles C. Holbrook, Judge. Isaac W. Bice was convicted of the violation of an ordinance prohibiting the sale of intoxicating liquors within the corporate limits of the town of Monte Yista, and he appeals.

This was an action by the people against.appellant for the violation of an ordinance of the town of Monte Yista involving the sale of intoxicating liquors within the corporate limits of the town.

From a judgment imposing a fine of $50.00 and costs, appellant appealed to the court of appeals.

The complaint is' in five counts, alleging five violations of an ordinance in the following language:
