Gateway Coal Company (employer) petitions for review of an order of the Workmen’s Compensation Appeal Board (Board) affirming the decision of the referee to grant benefits to Frank Laboda (claimant).

Claimant filed an occupational disease claim against his former employer alleging he was disabled as a result of coalworkers pneumoconiosis as of November 25, 1985. Hearings were held before the referee who found that claimant had pneumoconiosis, but was neither partially nor totally disabled. Litigation costs were awarded to claimant’s counsel, but no weekly compensation…
