This was a suit in equity, commenced by School District No. 4 of Choctaw County, the defendant in error herein, as plaintiff, against Ed Linthicum, as county treasurer of said county, the plaintiff in error herein, as defendant, for the purpose of enjoining the defendant as treasurer from paying into the common school fund of the state certain moneys collected by him for the support of the common schools.
