Defendant, Richard Bartlett, appeals from an order of the circuit court of Du Page County denying his petition for habeas corpus relief brought under the Code of Civil Procedure (Ill. Rev. Stat. 1981, ch. 110, par. 10 — 124(2)).

On June 1, 1979, defendant was convicted of the offense of armed robbery (Ill. Rev. Stat. 1981, ch. 38, par. 18 — 2(a)) and on August 7, 1979, was sentenced to incarceration with the Department of Corrections for a term of four years to four years and one day.
