INTRODUCTION

The plaintiff, Michael Kevin DuPont (“DuPont”), is a prisoner currently incarcerated at MCI-Cedar Junction in Walpole. In 1993, the Department of Corrections (“DOC”)2 sentenced DuPont to an 18-month term in the Departmental Disciplinary Unit (“DDU”) after DuPont committed a serious violation of prison rules.3 DuPont then filed this suit for declaratory and monetary relief, claiming that his confinement violated various portions of state and federal law.
