This is an action for damages for personal injuries, brought by the plaintiff against the defendant in the circuit court for the county of Hillsdale. Plaintiff recovered a judgment for $738 and costs, and the case is brought to this court by the defendant on a writ of error.
The facts are not in dispute, but are contained in a written stipulation, agreed upon by counsel, which reads in part as follows:
