This is an action for damages growing out of an alleged assault and battery. The petition was in the usual form; it prayed for the recovery of compensatory damages only. The answer consisted of a general denial and an affirmative defense. The latter was set forth as follows:
“Further answering, defendant says that while he admits that he struck plaintiff at the time alleged in the plaintiff’s petition he denies that such striking was unlawfully, wilfully, maliciously and feloniously done, but avers the fact to be that he went to see plaintiff on a lawful mission, with a peaceful purpose, and…
