[1] This is a continuation of the litigation involved in the case of the Virginia-Western Power Co. v. City of Clifton Forge, 125 Va. 469, 99 S. E. 723, 9 A. L. R. 1148. On the former appeal the respective rights and duties of the parties were very fully considered and passed upon, and the validity and binding effect of the contract of franchise between the city and the predecessor in title of the appellee were upheld as to the service stipulated for in the franchise.
