JOSEPH F. ANDERSON, Jr., District Judge.

This matter is presently before the court on cross-motions for summary judgment. The court heard argument on these motions on July 7, 1995 and, at the conclusion of the hearing, took the motions under advisement. Thereafter, both parlies filed supplemental memoranda in support of their respective positions. For the reasons that follow, the Defendants’ motion for summary judgment is granted, and the Plaintiffs motion for summary judgment as to liability is denied.
