(after stating the facts) : The first assignment of error is based on the refusal of the court to permit' the defendant’s attorneys to propound to Willie Clark, a State witness, on cross-examination, the following question : “Before you got down to Danford was she on top of the fence?” The question was designed to show that the mother of Willie Clark had left their house and gone to the fence, some thirty or forty yards, and had gotten up on the fence so that she could see what was occurring *12down tlie road where the shooting occurred.
