LEE, Circuit Judge.
Appellees, employees of appellant, brought this "action under Section 16(b) of the Fair Labor Standards Act of 1938, 29 U.S.C.A. § 216(b), to recover alleged unpaid minimum wages and overtime pursuant to Sections 6 and 7 of the Act, 29 U.S. C.A. §§ 206, 207. A motion to dismiss was granted as to certain of the employees.1 This Court affirmed.2 The Supreme Court reversed and remanded the case for further proceedings. 318 U.S. 125, 63 S.Ct. 494, 87 L.Ed. 656.
