This is an action of tort to recover damages for personal injuries, sustained by the plaintiff by reason of a defective manhole cover in the sidewalk which the defendant, as alleged, was bound to keep in repair.

At the close of the evidence the judge on the defendant’s motion directed a verdict for the defendant, and the plain*519tiff excepted. The judge “reserved the case for report to the Supreme Judicial Court at the request of both parties upon the stipulation that if, disregarding any evidence improperly admitted after objection and exception, the direction is error judgment shall be entered…
