OPINION OF
THE COURT.
This action is brought by the plaintiffs, to recover damages for an injury done to the Yorktown, the plaintiff’s boat, by the Talma, the boat of the defendants. The collision took place at the Dead Man’s Bar shute, on the Mississippi river, the 16th of March, 1845. The Yorktown was descending the river, and the Talma ascending it. Coleman Stewart was pilot on the Yorktown, and between one and two o’clock at night was descending the Dead Man’s Bar shute, about two hundred yards from the Louisiana shore.
