Plaintiff Hitachi Koki USA, Ltd. (“Hitachi”) seeks review under 35 U.S.C. § 145 of the denial by the United States Patent and Trademark Office’s Board of Patent Appeals and Interferences (“Board”) of Hitachi’s application for a patent for its desktop cutting machine with a tiltable saw (“the Hitachi device”). After denying the parties’ cross-motions for summary judgment, see Hitachi Koki Co., Ltd. v.
