—Order of the Supreme Court, New York County (Herman Cahn, J.), entered August 26, 1994, which, inter alia, granted plaintiffs’ motion for partial summary judgment on the second cause of action, is unanimously modified, on the law, to grant defendant partial summary judgment to the extent of declaring that the 20% video royalties are includable in gross receipts, and to grant the motion for summary judgment dismissing defendant’s counterclaim, and otherwise affirmed, without costs or disbursements.
