The judgment of the court was pronounced by

Rost, J.

The plaintiff claims $291 66, the amount of one month’s rents of a tenement leased by him to the defendant for a term of years, three of which were unexpired at the time; and further alleging that the defendant was about to leave the premises, and that he was liable for'the rent until the expiration of the lease. He obtained a provisional seizure of the merchandise in the store for the sum of $10,791 66.
