Green, J.:
The State of Kansas appeals from a judgment of the trial court dismissing the charge of unlawful acts involving proceeds derived from violations of the Uniform Controlled Substances Act against the defendants Valeria Romo-Uriarie, Leroy J. Mader, and Aaron J. Fredrickson. The trial court determined that State v. McGrew, 29 Kan. App. 2d 1051, 36 P.3d 334 (2001), controlled.
