At issue in this case is a motor vehicle liability policy excluding personal injury protection (PIP) coverage for injuries sustained in a motorcycle accident.
The facts of the case are undisputed. William R. DeJarnette, Jr. was riding on a motorcycle as a passenger. The motorcycle went out of control and overturned. As a result of the incident DeJarnette suffered injuries with consequent medical expenses and loss of earnings.
