OPINION OF THE COURT BY
FREAR, C.J.
This is a statutory action to quiet title. The defendants, appearing specially for the purpose, moved to quash the summons or the service thereof, on the ground that it was not served on the *402defendant C. M. Hyde. The motion was granted and the plaintiff excepted. He excepted also to several preliminary rulings rejecting offers made by him to remedy the alleged defect.
