The plaintiff, Linda Mayer, appeals from the *267entry of summary judgment in favor of the defendant, the Medical Malpractice Joint Underwriting Association (JUA),1 on all four counts contained in her complaint. At issue is whether the JUA, under the terms of its policy, is required to pay prejudgment interest to the extent that it exceeds policy limits. Also at issue is whether the JUA’s refusal to settle the underlying suit provides a sufficient basis for a claim of negligence or breach of the implied covenant of good faith, thus precluding summary judgment.
