In August, 1930, Will Moss was convicted of involuntary manslaughter in the commission of an unlawful act. This conviction was affirmed by this court on April 1, 1931. See Moss v. State, 43 Ga. App. 109 (158 S. E. 461). On May 7, 1931, the accused filed an extraordinary motion for a new trial, based largely upon alleged newly discovered evidence. The question presented is whether the trial judge erred in overruling this motion.
