This was a suit in replevin begun by Wood, the mortgagee of a stock of goods in a hardware store'at St. Joseph, Michigan, against Weimar, a sheriff, who had sqized the mortgaged property under certain writs of attachment, issued by the Circuit Court of Berrien County, Michigan, against Charles A. Stewart, the mortgagor. The case was tried by the court under a stipulation of the parties waiving a jury, and comes here on the facts and a bill of exceptions.
