In Case No. A97A1321, Hudson and Marshall IV, co-executors for the estate of Asa Marshall III, appeal from the judgment entered on the jury’s verdict finding Marshall III (hereinafter Marshall) liable for damages suffered by Santangelo when he fell through a deck railing at Marshall’s home. Santangelo cross appeals in Case No. A97A1401.
