I. INTRODUCTION.
On December 15, 2000, Plaintiff Lisa Niimi-Montalbo (“Niimi-Montalbo”), a former United States Army (“Army”) civilian employee, filed a nine-count First Amended Complaint, alleging that Defendant Thomas E. White (“White”), the Secretary of the Army, violated her constitutional and statutory rights in connection with her employment with and termination from the Army.
