The dissolution of the partnership between the plaintiffs, which is alleged to have occurred after the date fixed for the commencement of the intended term, and before any lease was demanded, does not of itself release the defendant from his obligation. He was to erect and finish the building, and prepare it for use, as their workshop. He would therefore be in a position to know when it was ready for occupation, and should then have tendered the lease, or at least have notified them that he was ready on his part to carry out the contract.
