Appeal from an order of the Supreme Court (Connolly, J.), entered October 16, 2009 in Albany County, which granted defendant’s motion for summary judgment dismissing the complaint.

Plaintiffs commenced this negligence action alleging that plaintiff Matthew J. Anton sustained injuries in June 2004 during the course of his employment as a correction officer with the Albany County Sheriffs Department (hereinafter Department).
