Appeal from a judgment of the County Court of Albany County, rendered March 17, 1978, upon a verdict convicting defendant of two counts of sodomy in the first degree. On October 27, 1977, the defendant and one Fordiin Tas were indicted and charged with two counts of sodomy in the first degree committed on September 10, 1977 at 8:45 p.m. and 8:50 *913p.m. at the Albany County Jail.
