(dissenting). — Rhodes, a witness for the state, testified that he sold strychnine to a woman whom he had never previously seen and whom on the trial of the case he identified as the appellant. The person purchasing the strychnine had, according to the testimony of Rhodes, inscribed in a book the words, “Mrs. J. D. Moore.” Upon the trial, according to the bill of exception, the appellant was forced and compelled to write in the presence of the jury, the following: “Mrs. Maude Long, Mrs. Jim Long, Mrs. J. D. Moore, middle of December.”
