Gookins, J. —

This was an action to recover real estate. Both parties claimed, the property under James A. Thompson, deceased — William Thompson, the plaintiff, as purchaser, and Martha E. Thompson, the defendant, as Ms devisee. The judgment below was for the defendant.

The plaintiff claimed title under a deed alleged to have been made by the deceased, which was never recorded, and has been lost. One Moore testified that in 1839, he was residing with the deceased; that at Ms request he accompanied him to the house of a justice of the peace, residing some eight or ten miles off; that James A.…
