This matter is before the court upon plaintiff’s motion for peremptory judgment pursuant to Pa.R.C.P. 1098. Plaintiff’s complaint seeks mandamus to require the City of Sharon to make payment under Article XIII of the contract between the City of Sharon and the Fraternal Order of Police.
