Watrous and -another, as executors, etc., from a judgment of the Supreme Court in favor of the plaintiff, entered in the.office of the clerk of the county of New York on the 17th day of March, 1906, upon the verdict of a jury, and also from an order entered in said clerk’s office on the 2d day of March, 1906, "denying the defendants’ motion for a new trial made upon the minutes.

This action was brought to recover the sum of $5,825, with interest thereon from a specified date, .the value of' certain clothing and wearing apparel sold and delivered by the plaintiff to one Katherine Ballou, now Katherine Brown, with whom the decedent had lived in meretricious relations, and wlio. had at various times passed as his wife. The decedent died June 21, 1903, and the clothing and wearing apparel were alleged to have been purchased between March tenth and June fifteenth of the same year.
