P. J. Jones, defendant ⅛ error herein, was plaintiff, and Texas Electric Railway Company, plaintiff in error herein, was defendant in this case in the district court of Hill county. For convenience the parties will be designated as they appeared in that court Plaintiff sued to *981recover of defendant damages for injuries to his person which he alleged he received while in the employ of defendant.
