BOOKHOHT, Associate Justice.
The defendants in error sued Charles B. White, plaintiff in error, to set aside a purchase by him of certain land at sheriff’s sale under an order of sale issued out of the District Court and to have the sale and deed to him annulled. The case was tried by the court without a jury and judgment rendered against White in accordance with the prayer of the petition setting the sale aside. White prosecutes error.
