Appeal by the state of Montana on relation of James Keane from a judgment dismissing a proceeding to review the action of the board of county commissioners of Big Horn county in creating a herd district.

On April 4, 1927, a petition for the creation of a herd district, as therein described, was filed with the county clerk of Big Horn county and was thereupon presented to the board of county commissioners of that county.
